PhotoAI: AI Art and Face Swap
Effective Date: August 15, 2026  |  Last Updated: August 22, 2026

This Privacy Policy describes how IE EVGENII ALEKSANOV ("we," "us," or "our") collects, uses, and discloses information when you use our mobile application, PhotoAI: AI Art and Face Swap (the "App"), downloaded from the Apple App Store or third-party app stores.

We respect your privacy and are committed to protecting your personal data. Please read this Privacy Policy carefully to understand our practices regarding your information and facial data.

1. Information We Collect and Use

We collect and use specific information with your explicit permission to implement core application features, process photos, and provide a seamless AI-generation experience:

A. Information You Provide Directly

  • Photo & Gallery Access: We access your device gallery only when you select photos or videos to apply AI art, face swap, filters, or photo enhancements. We never transfer or inspect your entire photo library.
  • Camera Access: We access your device camera only when you choose to take a real-time photo directly inside the App to generate AI art or perform face swaps.

B. Technical & Device Information

  • Device Specifications: Hardware model, manufacturer, operating system version, screen resolution, CPU/GPU architecture, mobile network info, and installed app packages required to ensure feature compatibility and optimize AI processing speed.
  • Local Storage & Cache: We use local device storage to temporarily cache processed images, app preferences, custom settings, and recent edits to enhance user experience.

C. Information Collected Automatically via Third-Party SDKs

We integrate reliable third-party Software Development Kits (SDKs) for in-app advertising, attribution, and app stability:

  • Google AdMob (Advertising): Serves contextual or personalized in-app advertisements. AdMob collects device identifiers (e.g., IDFA), IP address, and interaction data.
  • Liftoff / Vungle & Unity Ads (Advertising Networks): Used to deliver video and interstitial ad units. These networks may collect technical identifiers to deliver and optimize video advertisements.
  • AppsFlyer & Tenjin (Attribution & Analytics): Mobile Measurement Partners (MMP) used to analyze marketing campaigns, measure install attribution, track ad revenue, and evaluate app usage habits. They collect non-personally identifiable technical data (device ID, OS version, IP address, launch events).
  • Google Firebase (Analytics & Diagnostics): Used for crash reporting (Crashlytics) and performance monitoring to ensure application stability and fix performance bugs.

2. Processing of Facial Data (AI Art & Face Swap)

Because our App offers face swap, face manipulation, and AI art filters, we process photos containing human faces under strict privacy safeguards:

A. What Facial Data We Collect

When you upload a photo or take a picture using the camera to apply a face swap or AI filter, our system detects faces and extracts facial key points (mathematical vectors representing the position of eyes, nose, mouth, and face contours). We do not create raw biometric identifiers for identity verification.

B. How We Use Facial Data

Facial key points and uploaded photos are used exclusively to align, render, and apply chosen AI art effects, face swaps, or digital transformations onto your photo.

C. Storage and Processing Infrastructure

To perform complex AI computations, your uploaded image and extracted facial key points are transmitted over encrypted protocols (HTTPS/SSL) directly to our proprietary backend service deployed on secure GPU cloud infrastructure (including RunPod GPU servers). Processing is executed entirely within our private custom environment.

D. Facial Data Retention & Auto-Deletion

Facial data and images are held strictly in server RAM/cache for processing purposes only. All uploaded images and associated facial key points are automatically and permanently deleted from our servers within 24 hours following completion of the processing request.

3. How We Use the Collected Information

We use the technical and usage data strictly for the following operational purposes:

  • Delivering AI image processing, face swap generation, and photo editing features.
  • Serving relevant in-app advertisements (personalized or contextual).
  • Analyzing app performance, detecting bugs, and improving overall stability.
  • Measuring the effectiveness of ad campaigns, install attribution, and retention trends.

We DO NOT sell, rent, trade, or share your personal information or facial data with third parties.

4. Third-Party Privacy Policies

Third-party service partners operate under their respective privacy policies. You can review their practices using the links below:

5. Apple App Tracking Transparency (ATT) & Advertising Choices

On iOS devices, we strictly comply with Apple’s App Tracking Transparency (ATT) framework. Advertising and attribution SDKs will only access device identifiers (such as IDFA) for tracking or personalized advertising if you explicitly grant permission when prompted by the iOS dialog.

You can modify or revoke your tracking choices at any time via Settings > Privacy & Security > Tracking on your iOS device.

6. European Union (EEA/UK) Rights (GDPR)

If you reside in the European Economic Area (EEA), United Kingdom, or Switzerland, you have specific data rights under the General Data Protection Regulation (GDPR):

  • You have the right to grant, withhold, or withdraw your consent for personalized advertising and data processing at any time.
  • Consent choices are collected using Google’s User Messaging Platform (UMP) under the IAB TCF v2.2 framework.
  • You may update or revoke your consent preferences anytime via the in-app Privacy Settings menu.

7. US State Privacy Rights (CCPA/CPRA)

If you are a resident of California or other US states with applicable privacy regulations, you have the right to opt-out of the "sale" or "sharing" of personal identifiers for targeted advertising. You can exercise this choice through the consent banner presented upon launching the App or via the in-app privacy settings.

8. Children's Privacy

Our App is designed for a general audience and is not directed to children. We do not knowingly collect personal information or facial data from children under the age of 13 (or 16 in certain jurisdictions). If you become aware that a child has provided us with personal data, please contact us immediately so we can promptly delete such information.

9. Changes to This Privacy Policy

We may update our Privacy Policy periodically to reflect changes in our legal obligations, technical infrastructure, or features. Any updates will be posted on this page with a revised "Last Updated" date. We encourage you to review this Privacy Policy from time to time.
