Terms of Service

1. License and Scope of Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on iOS and other supported devices that you own or control, solely for your personal, non-commercial entertainment purposes.

You agree not to:

• Copy, modify, adapt, translate, or create derivative works based on the App or any of its content.
• Reverse engineer, decompile, disassemble, or attempt to extract or derive the source code of the App.
• Rent, lease, lend, sell, redistribute, or sublicense the App to any third party.
• Use the App for any illegal, unauthorized, fraudulent, or harmful purpose.
• Interfere with or attempt to disrupt the integrity or performance of the App or third-party ad delivery networks.

2. Intellectual Property Rights

All rights, titles, and interests in and to the App—including but not limited to software code, game mechanics, level designs, algorithms, graphic assets, animations, sound effects, user interfaces, text, and logos—are and will remain the exclusive property of IE EVGENII ALEKSANOV and its licensors.

The App is protected by copyright, trademark, and other intellectual property laws of Georgia and international treaties. Nothing in these Terms grants you any right or license to use our trade names, trademarks, or logos without our prior written consent.

3. In-App Advertisements and Services

The App is made available to you free of charge and is supported by third-party advertisements served via Google AdMob. Advertisements may link to third-party websites, applications, or services that are not owned or controlled by us.

We do not endorse, guarantee, or assume responsibility for any third-party advertisements, products, services, or websites. Any interactions or transactions with third-party advertisers are solely between you and the respective third party.

4. Privacy and Third-Party Data Processing

Your privacy is paramount to us. The App functions primarily offline, but utilizes integrated third-party SDKs (such as Google AdMob, Google Firebase, and AppsFlyer) for advertising, analytics, crash reporting, and install attribution.

Collection and processing of technical data by these third-party services are subject to our Privacy Policy. By accessing or using the App, you acknowledge that you have read and understood our Privacy Policy and consent to the data collection practices described therein.

5. Apple App Store Terms

These Terms are concluded between you and IE EVGENII ALEKSANOV only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

• Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance & Support: We are solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services.
• Warranties & Refund Claims: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Product Claims & IP Protection: We, and not Apple, are responsible for addressing any claims relating to the App, including product liability claims, legal compliance, or third-party intellectual property infringement claims.
• Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms and will have the right to enforce these Terms against you.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IE EVGENII ALEKSANOV, ITS AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US (IF ANY) TO ACCESS OR USE THE APP.

8. Changes to These Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. Any changes will become effective immediately upon posting the revised Terms on this page with an updated "Last Updated" date. Your continued use of the App following the posting of any changes constitutes your full acceptance of those changes.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. Any legal action, suit, or dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Georgia.
